1. About this Privacy Statement

The protection of your personal data is important to us and we want to be transparent about how we use your data. With this statement, we would like to inform you about how we handle your personal data.

In this statement, we explain to you:

- What personal data we collect from you;
- For what purpose we use this data;
- On what legal basis we need to use this data;
- The types of parties with which we share this data;
- How we protect your personal data; and
- What rights you have in relation to your personal data.

 

This Privacy Statement applies to personal information processed by entities and subsidiaries of PACCAR Holding B.V., including DAF entities such as DAF Trucks N.V. and PACCAR Financial entities. Where we process personal data about you in a context other than that described in this Privacy Notice, we will provide more specific information in addition to the information in this Notice if necessary.

This Statement was last updated on May 16, 2022 and will be reviewed and updated regularly.

2. Our commitment to your privacy

We are committed to treating your personal data with care and use it in accordance with applicable security standards. We delete or anonymize the data as soon as we no longer need it for the processing purposes described in the data subject-specific sections of our privacy webpage. We only collect the personal data that we need to achieve these purposes. Finally, we ensure that your data remains as accurate and secure as possible – by implementing organisational, legal and technical (IT) measures – and is always up-to-date.

3. Who is responsible for your personal data?

The entities and subsidiaries of PACCAR Holding B.V. are responsible for the processing and protection of your personal data. "PACCAR", "we", "us" and "our" in this statement refer to entities and subsidiaries of PACCAR Holding B.V., such as DAF entities – including DAF Trucks N.V. – and PACCAR Financial entities.

4. What personal data do we process, on what basis and for what purposes?

The links below provide an overview of the types of personal data we process about you. We have also included the purposes for which we use this personal data, and the legal basis for processing your personal data. If we process your personal data in a materially different way than stated below, we will notify you separately.

How long do we keep your personal data?
We will retain your personal data for as long as it is necessary for the purposes for which we collected it, within the legal limits and our own internal policies for retaining it. Please note that your personal data may be processed for an additional period if we are required by mandatory law to store the data for a certain period of time, for scientific research purposes, statistical purposes and/or for the establishment, exercise or defence of legal claims.

5. Who do we share your personal data with?

We share your information with PACCAR-related entities, which are subject to the same data protection standards. In addition to our own entities, we also share personal data with some third parties, which is summarized in the following subsection.

How do we protect your personal data when we share it with parties that are
not subject to European data protection rules 
DAF Trucks N.V. is part of the PACCAR group? Where necessary to achieve the data processing we are pursuing, personal data may be shared with PACCAR-related entities inside and outside the European Economic Area, provided that there is a level of protection that is substantially equivalent to the EU standards (GDPR).

 

If we share personal data with an organisation that is not subject to European data protection rules and that cannot rely on an adequate decision by the European Commission, we protect your personal data by means of appropriate safeguards. An example that we often use is the European Commission's standard contractual clauses. These ensure that the parties we share your personal data with have the same or similar standards of data protection as we do. These standard contractual clauses can be supplemented by additional technical and organisational measures.

6. How do we protect your personal data?

We want to protect the availability and integrity of your personal information and have implemented security measures to better secure your personal information. For example, we implement access controls, use appropriate measures for system and network security such as firewalls, patching, and secure portable devices with appropriate passwords. DAF Trucks N.V. has established an IT security and GDPR framework, as well as associated policies – for example, to combat data breaches – and mandatory standards to protect the confidentiality, availability and integrity of the assets we use to process your personal data.

7. What are your rights?

When we process your personal data, you have a number of rights that you can exercise at any time. Below we provide an overview of these rights, and what this means for you. You can exercise your rights by contacting dataprotectionofficer@daftrucks.com.

PACCAR will respond in writing to your request regarding your data protection rights within one month of receipt of your request. Depending on the complexity and number of requests, PACCAR may extend this period by an additional two months. PACCAR will notify you of such extension within one month of receipt of the request, stating the reasons for the delay. PACCAR will process your request to exercise your rights under this Clause 7 only after we have had an opportunity to properly identify you.

The right to access, correct and receive a copy of your personal data
We are committed to keeping all your personal data that we hold accurate, up-to-date, complete, relevant and not misleading. To ensure that we fulfill this promise, you have the right to review, correct, or update your personal information at any time. Upon request, we will also provide you with a copy of the personal data we hold about you.

The right to data portability
You have the right to receive your personal data in a structured, commonly used and machine-readable format if we have processed your personal data for the following legal reasons:
a) You have given us consent to process your personal data for a purpose that we have notified to you in advance; or
b) We have processed your personal data to facilitate a contract with you; or
c) We have processed your personal data using automated means (such as profiling).

The right to erasure of your personal data
You have the right to request that we delete your data in the following cases:
a) Your personal data is no longer necessary in relation to the purposes for which we collected it; or
b) You withdraw the consent you had previously given us to process your personal data, and there is no other legal reason to process that personal data; or
(c) You object to our processing of your personal information for PACCAR's legitimate interests;
d) The personal data is not processed in a lawful manner;
e) Your personal data must be deleted in order to comply with relevant legal requirements.

If you wish to delete the personal data we hold about you, you can let us know by contacting dataprotectionofficer@daftrucks.com. We will take reasonable steps to respond to your request in accordance with legal requirements. If your personal data that we process is no longer necessary for any purpose (including statistical purposes or for the establishment, exercise or defence of legal claims) and we are not required by law to do so.If you keep it, we will do what we can to remove it, destroy it or permanently remove the link with you as an individual.

The right to restriction of processing
You have the right to request that the processing of your personal data be restricted in the following cases:
a) You do not believe that the personal data we hold about you is accurate; or
b) The personal data is not processed lawfully, but instead of deleting the personal data, you prefer that we restrict the processing; or
c) We no longer need your personal data for the purposes for which we collected it, but you need it for the establishment, exercise or defence of legal claims; or
d) You have objected to the processing of your personal data and are waiting for verification as to whether your interests in connection with that objection outweigh the legitimate grounds for processing your data.

If you wish to restrict our processing of your personal data, you can let us know by contacting dataprotectionofficer@daftrucks.com. We will take reasonable steps to respond to your request in accordance with legal requirements.

The Right to Object or Withdraw
Consent You have the right to object to the processing of your personal information at any time, if the processing is based on legitimate interests of PACCAR or a third party. Please note that these types of requests may be rejected by us if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms. However, if you object to the processing of your personal data for direct marketing purposes, we will in principle always terminate the processing. In those situations, your rights almost always take precedence.

You have the right to withdraw your consent to the processing of your personal data at any time, if the processing is based on your consent. Withdrawing your consent means that we no longer have the right to process your personal data for the purpose for which you have given consent. If you wish to withdraw your consent, this will not affect the legitimacy of the data processing prior to that withdrawal. Withdrawal of the consent therefore does not have retroactive effect.

The right to lodge a complaint with a supervisory authority
